720 - Whoever vomits involuntarily does not have to make up the fast من ذرعه القيء فليس عليه قضاء

720 حدثنا علي بن حجر حدثنا عيسى بن يونس عن هشام بن حسان عن محمد بن سيرين عن أبي هريرة أن النبي صلى الله عليه وسلم قال من ذرعه القيء فليس عليه قضاء ومن استقاء عمدا فليقض [ ص: 99 ] قال وفي الباب عن أبي الدرداء وثوبان وفضالة بن عبيد قال أبو عيسى حديث أبي هريرة حديث حسن غريب لا نعرفه من حديث هشام عن ابن سيرين عن أبي هريرة عن النبي صلى الله عليه وسلم إلا من حديث عيسى بن يونس وقال محمد لا أراه محفوظا قال أبو عيسى وقد روي هذا الحديث من غير وجه عن أبي هريرة عن النبي صلى الله عليه وسلم ولا يصح إسناده وقد روي عن أبي الدرداء وثوبان وفضالة بن عبيد أن النبي صلى الله عليه وسلم قاء فأفطر وإنما معنى هذا أن النبي صلى الله عليه وسلم كان صائما متطوعا فقاء فضعف فأفطر لذلك هكذا روي في بعض الحديث مفسرا والعمل عند أهل العلم على حديث أبي هريرة عن النبي صلى الله عليه وسلم أن الصائم إذا ذرعه القيء فلا قضاء عليه وإذا استقاء عمدا فليقض وبه يقول سفيان الثوري والشافعي وأحمد وإسحق

720 Ali bin Hajar narrated to us, Isa bin Yunus narrated to us, on the authority of Hisham bin Hassan, on the authority of Muhammad bin Sirin, on the authority of Abu Hurairah, that the Prophet, may God bless him and grant him peace, said: “Whoever vomits involuntarily does not have to make up the fast, and whoever vomits intentionally must make up the fast.” [p. 99] He said: “And in this chapter there are reports on the authority of Abu al-Darda’, Thawban, and Fadala bin Ubaid.” Abu Isa said: The hadith of Abu Hurairah is a good, strange hadith. We do not know it from the hadith of Hisham, on the authority of Ibn Sirin, on the authority of Abu Hurairah, on the authority of the Prophet, may God bless him and grant him peace, except from the hadith of Isa bin Yunus, Muhammad said: I do not see it preserved. Abu Isa said: This hadith has been narrated from other sources on the authority of Abu Hurairah on the authority of the Prophet, may God bless him and grant him peace, but its chain of transmission is not authentic. It has been narrated on the authority of Abu al-Darda’, Thawban, and Fadalah ibn Ubayd that the Prophet, may God bless him and grant him peace, vomited and broke his fast. The meaning of this is that the Prophet, may God bless him and grant him peace, was fasting voluntarily and vomited and became weak, so he broke his fast. This is how it was narrated in some of the hadith with an explanation. The scholars act upon the hadith of Abu Hurairah on the authority of the Prophet, may God bless him and grant him peace, that if a fasting person vomits involuntarily, he does not have to make it up, but if he vomits intentionally, he must make it up. This is what Sufyan al-Thawri, al-Shafi’i, Ahmad, and Ishaq say.
